Digital Marketing in the US

We are an Indian engineering team working with businesses in the US. Written scope before any code, and a fixed quote in USD.

Working hours

Our day ends at 07:30 in the US (08:30 on summer time), before yours begins, so we work asynchronously: written updates land overnight and are waiting when you start.

Quoted in USD

There is no general VAT in the US at present, so the quote is the amount you pay.

Data protection

Work for this market is scoped against state privacy law, principally the CCPA and CPRA in California, agreed before development starts rather than retrofitted afterwards.

Written scope

Every engagement starts with a written scope and a fixed USD quote within 24 hours, so the price is set before work begins.

About Digital Marketing

Most digital marketing agencies sell you reports, slides full of impressions, reach, and engagement metrics that don't pay rent. We sell measurable revenue and qualified leads. Our digital marketing work spans SEO, Google Ads, Meta Ads, email automation, content marketing, and the analytics setup that ties every channel back to actual money. Every retainer reports against your North Star metric, revenue, leads, signups, not vanity numbers.

What the engagement includes

  • SEO, technical, content, and local
  • Google Search and Performance Max Ads management
  • Meta (Facebook + Instagram) Ads management
  • LinkedIn Ads for B2B
  • Email marketing automation (Klaviyo, HubSpot, Mailchimp)
  • Content strategy and long-form blog writing
  • Landing page design and CRO (conversion rate optimization)
  • Google Tag Manager + GA4 + Meta Pixel + server-side tracking

What CAN-SPAM, state texting laws and the FTC's Endorsement Guides ask of a US campaign

An American email list is the place where the law asks for little up front and a lot inside every message. CAN-SPAM does not require consent before a commercial email goes out, and the FTC's compliance guide says the law makes no exception for business-to-business email, so a cold B2B sequence and a customer newsletter carry the same duties. Each message needs accurate From, To, Reply-To and routing information, a subject line that reflects the content, a clear disclosure that it is an advertisement, a valid physical postal address and a plain explanation of how to opt out. That address can be a street address, a post office box registered with the Postal Service or a private mailbox registered with a commercial mail receiving agency. The opt-out has to keep working for at least 30 days after the send and be honored within 10 business days, it cannot ask for more than an email address or a visit to a single web page, and once someone has opted out their address cannot be sold or transferred. Which duties apply turns on the message's primary purpose. The FTC treats an email as commercial if the subject line reads as a promotion or the transactional content does not come mainly at the beginning, so an order confirmation with an offer stacked above the order details can tip over. The guide puts the civil penalty at tens of thousands of dollars for each email in violation, adjusted for inflation each year, says both the company whose product is promoted and the company that actually sends the message may be held responsible, and says hiring someone else to send does not contract that away. So the suppression list lives in one place that the email platform, the CRM and any sales sequencer all read before they send, rather than three lists that drift apart. Whether a given message is commercial or transactional is for your own counsel.

Text messages are where US marketing law gets expensive, because recipients can sue. Under the FCC's TCPA rules a marketing text sent with an autodialer needs prior express written consent, a written agreement bearing the recipient's signature that authorizes telemarketing messages to that number. Since 11 April 2025 the rules let a person revoke consent by any reasonable method, a reply of stop, quit, end, revoke, opt out, cancel or unsubscribe counts, and the request must be honored within a reasonable time not exceeding ten business days. One confirmation text without marketing is allowed, presumed fine if sent within five minutes. A further rule treating an opt-out from one kind of message as an opt-out from everything that sender sends has been postponed more than once and is not yet in force as of this writing, so a global opt-out should be a setting in the opt-out store, not a migration. Federal rules bar solicitation before 8 a.m. or after 9 p.m. at the recipient's location, and states add their own rules. Florida's Telephone Solicitation Act counts a text as a telephonic sales call, requires signed written consent for automated sales messages with a disclosure that signing is not a condition of purchase, and lets a recipient recover $500 per message, trebled if the violation was willful or knowing, once they have replied STOP and 15 days have passed. Texas SB 140 brought texts inside the state's telephone solicitation law from 1 September 2025 and made violations actionable under its Deceptive Trade Practices Act. When a federal challenge to it was dismissed on 17 November 2025, the order recorded the State's position that consent-based text marketing falls outside Chapter 302 registration, which is a stated reading rather than a ruling. So each number carries the consent wording, the timestamp and the page it came from, and sends are scheduled to the recipient's time zone, which an area code only approximates. Which state laws reach your list is for your own counsel.

Creator and influencer work in the US runs on the FTC's Endorsement Guides, revised on 29 June 2023, and the revision names the agency. Advertising agencies, public relations firms, review brokers and similar intermediaries may be liable for their roles in creating or disseminating endorsements they know or should know are deceptive, alongside the advertiser and the endorser. A material connection such as payment or free product has to be disclosed clearly and conspicuously, which on social media means unavoidably, and the FTC says a platform's built-in disclosure tool might not be adequate on its own. Its published answers accept #ad or Sponsored at the start of a post, but not buried among other hashtags at the end, and not only in a profile bio or a video description: a visual endorsement needs a disclosure on screen and a spoken one needs it said aloud. Creators cannot describe their experience of a product they have not tried, and the advertiser is expected to train its network, search periodically for what it posts and act on problems, with closer supervision for health products than for fashion. So a US creator brief lists the claims the creator may and may not make, fixes the disclosure wording and where it sits, and builds in review before anything is posted. Health is also where targeting itself is restricted. Washington's My Health My Data Act makes it unlawful to set a geofence of 2,000 feet or less around a place providing in-person health care in order to identify or track people seeking care, collect their health data, or send them ads related to it, which removes clinic-radius campaigns in that state. Its definition of consumer health data reaches information inferred from non-health data, including by algorithms, so a lookalike or interest segment built around a condition gets the same scrutiny as a list of patients. How these rules apply to a particular campaign is for your own counsel.

How we work with US clients

A US engagement gets agreed twice. Once with the person who wants the thing built, and then again with legal, security, procurement and finance, who arrive separately and rarely in the same week. That second round is where a supplier outside the country loses the calendar: a master services agreement to redline, a security questionnaire, a certificate of insurance, and a vendor portal that assumes everyone it onboards can sign a W-9. Send all of it while the scope is still being written rather than in the week you wanted to start, and where the honest answer to a row is that we do not hold something, we write that in rather than leaving it blank.

You are also buying from a company you cannot drop in on, so the evidence has to do the work an office would otherwise do. What we send is live production URLs rather than a deck, a written scope with one fixed number against it, and the names of the people who will do the work rather than a bench that changes after signature. What we will also tell you is the shape of what you are hiring: a small team in Noida that has been building since 2021, not a firm that can put four more people on your project next Monday. If that is what your timeline needs, we say so before the contract rather than after it.

Questions US clients ask

Does our site have to meet ADA accessibility requirements?

If you are consumer facing in the US, build as though it does. Demand letters over inaccessible websites are routine and cheap to send, federal work brings Section 508 with it, and the Department of Justice rule under Title II sets WCAG 2.1 AA for state and local government entities on a timetable your counsel can confirm for your size band. We work to WCAG 2.2 AA and test with a screen reader rather than relying on an automated scan, because automated tools catch perhaps a third of real issues and the other two thirds are the ones that end up in a letter.

How do we know you will still be here in two years?

Nobody can promise you that, and a supplier who does is selling something. We have been building since 2021 and we maintain what we build, which is the honest version of the answer. The useful version is that it should not have to matter. The repository is in your GitHub organization, the domain and hosting accounts are in your company name, the stack is Next.js, Laravel, Flutter and Postgres rather than anything only we can read, and the handover document exists before you ask for it. If we vanished tomorrow, another agency could pick it up without needing to call us.

Can you sign our NDA and work under our MSA?

Yes to the NDA. Send your standard one and it comes back signed within 24 hours, before you describe the project in any detail. Yes to the MSA too, with the caveat that we read it properly rather than signing to be agreeable. The two clauses we usually come back on are unlimited liability, where we ask for a cap tied to the fees, and an IP clause drafted broadly enough to sweep in the internal tooling we bring to every project. Everything built for you transfers to you in full on final payment. We mark up those two and sign the rest.

Something breaks at two in the afternoon in Chicago. What actually happens?

Two in the afternoon in Chicago is past midnight here, half past midnight in summer and half past one in winter, so the truthful answer depends on what you are paying for. Monitoring does not keep our hours and the alert fires whatever the clock says. Whether a person is awake to act on it depends on your plan, because we are not a 24/7 on-call operation as standard, and we would rather tell you that while you are choosing a plan than while your checkout is down. Without out-of-hours cover written into the contract, the realistic answer is that it is picked up at the start of our day, which is the middle of your night, and you should price that in when you decide.

Digital Marketing: common questions

How much does digital marketing cost?

Starter retainers (SEO + 1 paid channel): $170-$340/month. Growth retainers (multi-channel + content team): $340-$910/month. Performance / enterprise: $910+/month. Ad spend is in addition to retainer fees and depends on your CAC targets, typical D2C brands run $570-$5,700/month in ad spend.

How long until I see results from digital marketing?

Paid ads (Google, Meta): first conversions within 7-14 days, optimized within 30-45 days, scaled within 60-90 days. SEO: first impressions in 4-8 weeks, meaningful clicks in 2-3 months, dominant rankings in 6-12 months. Email automation: starts driving revenue from week one once flows are live.

Do you also build the landing pages and email templates?

Yes, and this is what makes us different from most marketing agencies. We design and code high-converting landing pages on Next.js or Webflow, write the email copy, build the Klaviyo flows, and instrument the tracking. No 'we'll need a dev team for that' delays.

Will you manage my Google Ads / Meta Ads spend directly?

Yes. We get manager access to your ad accounts and run campaigns directly. We're Google Ads and Meta Blueprint trained. Ad spend stays on your card / billing, we just optimize the campaigns and report on performance.

Do you do influencer or PR campaigns?

We run influencer marketing campaigns for D2C brands (Instagram + YouTube focus) when it fits the channel mix. We don't do traditional PR (press releases, journalist outreach), that's a specialist field and we partner with PR agencies when clients need it.
